Trade Secrets Watch previously had its eye on the U.S. Trade Representative’s investigation on China’s alleged IP theft under Section 301 of the Trade Act of 1974. As an update, late last month, President Trump announced the imposition of tariffs on as much as $60 billion worth of Chinese goods due to China’s alleged IP theft and intimidation tactics to obtain American technology. China, in turn, proposed tariffs of its own on 128 American products, valued at $3 billion.

On April 3, the USTR announced its list of hundreds of Chinese products against which it proposes to impose 25 percent import duties. Whether these tariffs will come to fruition, or serve as a further bargaining chip to move China’s IP protection policies forward, remains to be seen. In the meantime, Orrick’s International Trade & Compliance Team is providing in-depth coverage on the Section 301 tariffs and the impact on the global economy. Check out their insights here and stay tuned for more coverage as these proposed tariffs work their way through the public comment process, and potentially provide opportunities for diplomatic resolutions.
