Several studies indicate that patent litigation by patent assertion entities (PAEs), pejoratively known as “patent trolls,” has been on the rise in the last several years. The financial impact of these lawsuits has been widely debated. Two academics who have spent a large amount of time studying the financial consequences of PAE litigation, James Bessen and Michael Meuer, have released a new study arguing that such litigation costs the economy $29 billion a year in direct costs. In contrast, a 2013 GAO Report “Assessing Factors That Affect Patent Infringement Could Help Improve Patent Quality” reveals that the conventional wisdom today about a so-called “patent troll litigation explosion” is unsupported by the facts.
Orrick attorneys Christy Von der Ahe and Ben Lin will identify some of the major players behind current PAEs and discuss the pros and cons of defensive patent licensing networks, patent litigation insurance, and other private initiatives to mitigate the cost of PAE litigation.
